A Conveyance of the land in this title and other land dated 12 July 1962 made between (1) Reverend Alan Pyburn Incumbent of the Benefice of the Vicarage of Dallington St. Mary Northampton (Indumbent) and (2) The Church Commissioners for England (the Commissioners) and (3) Adkins & Shaw (Builders & Contractors) Limited (Purchasers) contains covenants details of which are set out in the schedule of restrictive covenants hereto.
The land is subject to the following rights reserved by the Conveyance dated 12 July 1962 referred to above:-

EXCEPT AND RESERVED unto the Incumbent and his successors full and free right and liberty without obtaining the consent of or making any compensation to the Purchasers or other the owner or owners occupier or occupiers for the time being of the said property thereby conveyed to deal in any manner whatsoever with any of the land belonging to the Incumbent adjoining or near to the said property thereby conveyed (including the Church and Churchyard) and to erect and maintain or suffer to be erected or maintained on such adjoining opposite or neighbouring lands any buildings whatsoever whether such building should or should not affect or diminish the light or air which would then or at any time or times thereafter be enjoyed for or in respect of the property thereby conveyed or any building for the time being thereon and (iii) the free flow of water and soil and the passage of water gas and electricity and or public or private services from any adjoining land belonging to the Incumbent (including the Church and Churchyard) through any drains and watercourses pipes conduits and cables then existing in the said property thereby conveyed or substituted therefor by the Purchasers.
The following are details of the covenants contained in the Conveyance dated 12 July 1962 referred to in the Charges Register:-
THE PURCHASERS to the intent and so as to bind (so far as practicable) the property thereby conveyed into whosesoever hands the same would come and to benefit and protect the said adjoining and neighbouring land belonging to the Incumbent and every part thereof thereby covenanted with the Incumbent and his successors and also by way of separate covenant with the Commissioners as follows:-
(a) That they the Purchasers would not at any time thereafter call or designate the messuage or dwellinghouse thereby conveyed or permit the same to be called or designated 'the Vicarage' or 'Dallington Vicarage' or by any other name which might suggest that the said property is occupied by the Incumbent of the said Benefice
(ii) That neither the property thereby conveyed or any part thereof nor any existing or future building thereon or on any part thereof should at any time thereafter be used as or for a place or amusement hotel tavern inn or public house nor should any spirituous or fermented liquors at any time be sold in or upon the same property or any part thereof and that no act deed matter or thing should at any time be done suffered or permitted in or upon the property thereby conveyed or any part thereof which would be or become a nuisance annoyance or disturbance to the Incumbent of his successors or which may tend to depreciate or lessen the value of the adjoining and neighbouring property belonging to the Incumbent
(iii) That no act deed matter or thing would at any time be done suffered or permitted in or upon the property thereby conveyed or any part thereof which would be or become a nuisance annoyance or disturbance to the Minster for the time being conducting or the congregation attending divine service in the Parish Church of Dallington or the Churchyard surrounding the same
(iv) before commencing any building or other works
on the property thereby conveyed and in any event within one year of the date thereof to erect and forever after maintain to the satisfaction of the Incumbent and his successors close boarded or such other type of fencesas may be acceptable to the Incumbent and his successors not less than 6 feet in height along the boundaries of the land edged red on the said plan adjacent to the land edged green between the points A-B B-C C-D F-G G- H and J-K marked on the said plan such fence between the points J-K marked on the said plan such fence between the points J-K to be set back not less than 15 feet from the base of the large cedar and fir trees standing on the said land edged green on the said plan.
(v) to repair and forever after maintain to the satisfaction of the Incumbent and his successors the walls between the points D-E marked on the said plan
(vi) not to lop or otherwise damage any overhanging boughs of the cedar and fir trees referred to in sub-clause (iv) of this clause and to take all reasonable steps to prevent damage to such of their roots as may be in the land thereby conveyed
(vii) not to develop or use the land thereby conveyed other than for private residential purposes only and to obtain all necessary consents and approvals under the provisions of the Town and Country Planning Acts and Local Authority Bye- Laws and in particular not to commence any building until the plans of each different type of houses for which consent and approval had been obtained and had been submitted to and approved by the Surveyor for the Incumbent or his successors and paying such Surveyors fee for the examination of each such plan.
(viii) not to erect any building of a greater height than 8 feet to eaves within 20 feet of any boundary adjacent to the Vicarage and Vicarage garden shown on the said plan and edged green.
